Data Privacy Framework Privacy Policy

EU-U.S. Data Privacy Framework, UK Extension to EU-U.S. Data Privacy Framework, and Swiss-U.S. Data Privacy Framework (collectively, “DPF” and the personal information collected in reliance on the DPF is “European Personal Information”)

Fly.io, Inc. (collectively, “Fly.io,” “we,” “our” or “us”) collects and processes European Personal Information for the purposes described in the Fly.io Privacy Statement. The Privacy Statement also identifies the types of third parties to which Fly.io discloses European Personal Information. Fly.io is responsible for the processing of European Personal Information it receives under the DPF, and subsequent transfers to any third party acting as an agent on its behalf. If third-party agents process personal data on our behalf in a manner inconsistent with the DPF Principles, we remain liable unless we prove we are not responsible for the event giving rise to the damage. Fly.io complies with the DPF Principles for all onward transfers of European Personal Information from the EU, the UK, and Switzerland, including the onward transfer liability provisions.

If you are located in the UK, EU, or Switzerland, you may have the right to access or submit requests to review, correct, update, or delete your European Personal Information. You may also have the right to exercise choice (opt-out) from our use of your European Personal Information for direct marketing purposes. You can exercise your rights by sending a written request to compliance@fly.io. We may limit or deny access to your European Personal Information where providing such access is unreasonably burdensome, expensive under the circumstances, or as otherwise permitted by the DPF or applicable law.

Enforcement and Recourse


Fly.io is subject to the investigatory and enforcement powers of the US Federal Trade Commission with respect to European Personal Information received or transferred pursuant to the DPF. In certain situations, we may be required to disclose European Personal Information in response to lawful requests by public authorities, including meeting national security or law enforcement requirements.

In compliance with the DPF Principles, Fly.io commits to resolve complaints about our collection, use, or disclosure of European Personal Information. Individuals located in the UK, EU, or Switzerland with inquiries or complaints regarding our commitment to the DPF should contact Fly.io at compliance@fly.io. Fly.io has also committed to cooperating with the panels established by the EU data protection authorities (“DPAs”), the UK Information Commissioner’s Office (“ICO”) and the Swiss Federal Data Protection and Information Commissioner (“FDPIC”), and to complying with the advice given by such authorities with regard to European Personal Information transferred from these jurisdictions in the context of providing services to our customers.

If a complaint cannot be resolved by Fly.io or by the EU DPAs, the Swiss FDPIC, or the UK ICO, you may under certain conditions be able to invoke binding arbitration.
